BellPal Online Terms of Sale

1 Scope

1.1

These terms and conditions “terms and conditions”) apply to all orders submitted or to be submitted by you for products and services which you are offered on or via www.bellpal.com (“the website”). Products and services you are offered on or via the website are offered by Bellpal AB, VAT no. 559079-6958, with registered address Maria Skolgata 83, 118 53 Stockholm, Sweden (hereinafter referred to as ”BellPal”).

1.2

Products and services offered on or via the website are intended for adults, and if you are under 18 years of age, you confirm that your parent, guardian or another responsible adult has given you permission in advance to make purchases on the website.

1.3

Please note that these terms and conditions are only intended to specify the terms and conditions that apply to orders submitted by you via the website and that the general terms and conditions that apply to your use of products and services which you are offered by BellPal are available on www.bellpal.com. Please note also that BellPal is the data controller in relation to the processing of personal data that is necessary for us to provide our services to you in accordance with the general terms and conditions. 2 Orders, prices and shipping

2.1

All orders submitted by you must be approved by BellPal. An agreement between you and BellPal is only valid once BellPal has approved the order and can only be entered into with customers who have a delivery address in Sweden.

2.2

All orders are subject to availability of the products and services, which is indicated in the online store, and BellPal reserves the right to fully or partly reject orders.

2.3

The prices that apply are those that are indicated on the website on the date the order is placed. BellPal reserves the right to change prices at any time, but such a change shall not affect orders placed prior to the change date. All prices include VAT (value added tax).

2.4

We charge a delivery fee of SEK 89 when you purchase a product through BellPal’s online store. We charge a fee of SEK 150 for unclaimed packages that are returned to us from Postnord.

3 Order process

3.1

If the customer wishes to purchase a product and/or service, he/she must choose a product and/or service to add to their cart and then select the quantity for each product and/or service.

3.2

On the checkout page, the customer can then complete their order by entering their payment card details, approving the terms of sale and then clicking “Order”.

3.3

Once the order has been placed, the customer will receive an e-mail confirming the order and payment.

4 Delivery

4.1

Our typical delivery time is 2-3 days. NOTE! Orders placed on weekends are shipped out the following Monday at the earliest. In the event of delays (and we have not informed you that the delivery time will be longer), contact us at the following e-mail address: support@bellpal.com.

4.2

We use Postnord Mypack collect (a Postnord service), which delivers the parcel to the nearest delivery point. The recipient is notified by text message. Delivery of subscription services is done electronically or through automatic activation. If your order contains several products, BellPal has the right to deliver and/or activate the products separately. Products ordered via the website are only delivered within Sweden.

4.3

If the product is lost or if you notice that the product has been damaged during transport, you must notify us immediately via our customer support (support@bellpal.com).

5 Payment methods

5.1

We offer payment via payment cards in collaboration with Stripe. You can choose to pay by debit and credit card. BellPal itself does not process any bank or credit card details. Pay securely with Visa, Amex or MasterCard online. Your payment is processed by Stripe with secure encryption and according to strict banking standards. Your payment card information is sent directly to the bank and cannot be read or downloaded by anyone besides your bank. When paying by debit or credit card, the terms and conditions enter into effect as soon as the card transaction has been approved. In the event that no payment is received after you place your order, the payment may automatically be cancelled by BellPal.

6 Right of withdrawal and returns

6.1

When purchasing a product and/or service on our online store, you, the customer, have a statutory 14-day right of withdrawal, which applies from the moment you have received an item you have ordered.

6.2

You must notify us that you wish to withdraw your purchase. by sending us an e-mail to support@bellpal.com. In your e-mail, you must include your name, address, e-mail address, order number and the products that you wish to return clearly. You are responsible for the return shipping costs, delivery and condition of the products upon return. You should therefore make sure the products are sent back robust packaging and its original packaging.

6.3

BellPal is not responsible for any products lost during return shipping. The product must be unused and in the same new condition as when it was received. You have the right to examine the product, but not to use or handle it in such a way that damages or alters its condition. If the product is damaged or its condition has deteriorated upon return receipt, you may not receive a full refund. Concerning the refund amount, we reserve the right to deduct an amount corresponding to the depreciation compared to the product’s original value if the product has been used or damaged.

6.4

Exceptions to the right of withdrawal

The right of withdrawal does not apply to a service where the provision of that service has commenced with the consumer’s consent during the withdrawal period.

7 Claims and complaints

7.1

We inspect all products before they are sent to you. Should be product nevertheless be damaged or incorrectly dispatched when it arrives, we undertake – in accordance with applicable consumer protection legislation – to rectify the error free of charge.

You must always contact us for approval before returning a defective product. The complaint must be sent as soon as the defect has been discovered.

7.2

Any claims regarding faults or defects must always be sent to support@bellpal.com and include your name, address, e-mail address, order number and description of the fault. If we are unable to remedy the fault or deliver a similar product, we will refund you for the defective product in accordance with applicable consumer protection legislation. We will cover the cost of return shipping for approved claims.

7.3

We reserve the right to deny a claim if it is found that the product is not defective in accordance with applicable consumer protection legislation. In relation to claims/complaints, we follow the guidelines of the Swedish National Board for Consumer Disputes (Allmänna Reklamationsnämnden), see arn.se.

8 Warranties

8.1

In addition to the legal guarantee, BellPal provides a 24-month guarantee for purchased products. The warranty does not cover faults caused by accidents or similar incidents, damage, moisture damage, abuse, abnormal use, incorrect service or other circumstances for which the user is responsible.

8.2

If BellPal does not deliver an order, or if the delivered product is not what you have ordered, or if the product is defective or damaged or you have received an incorrect number of the product, BellPal can:

– repair the defective product or undertake re-delivery of the non-delivered product; or

– replace all the defective or damaged products with new ones; or

– refund the amount you paid for the product.

8.3

If you wish to make a warranty claim, you must contact BellPal at support@bellpal.com no later than 24 months from the date you purchased the product. The product must be returned to BellPal to the address provided by BellPal as soon as possible after you have contacted BellPal, along with a description of the fault.

8.4

BellPal can offer a loan product while your warranty issue is being resolved. If you would like a loan product, please contact BellPal.

9 Limitation of liability

9.1

We do not take responsibility for any indirect damages that may occur due to the product and/or service.

9.2

We do not accept liability for delays/faults caused by circumstances beyond the company’s control (Force Majeure). These circumstances include but are not limited to labour disputes, fire, war, government decrees or partial or failed deliveries from our suppliers.

10 Product information

10.1

We make reservation for any typographical errors on this website and the final sale of products. We do not guarantee that the pictures show the exact appearance of the products, as there may be a degree of colour difference depending on the monitor, photo quality and resolution. We always strive to present the products as accurately as possible.

12 Miscellaneous provisions

12.1

Any provisions in these terms and conditions that are prohibited or not legally enforceable in a jurisdiction shall not apply in such jurisdictions on the basis of the extent of such prohibition or unenforceability and shall not affect the remaining provisions in these terms and conditions. Such a prohibition or unenforceability shall be interpreted as closely as legally possible to its original wording and purpose. Any prohibition or unenforceability in a jurisdiction shall not make the provision prohibited or unenforceable in other jurisdictions.

13 Applicable legislation

13.1

These terms and conditions are subject to Swedish law and shall be interpreted on that basis, without prejudice to other compulsory laws in your country of residence. Accordingly, these terms and conditions shall be exclusively interpreted, enforced and rendered inapplicable in accordance with Swedish legislation, and any disputes arising from them and/or as a consequence of them shall be resolved exclusively in a Swedish court. If you are a consumer, any disputes shall be resolved in the court of your place of residence or place of stay on the basis of applicable law. Regardless of whether anything else is specified, nothing shall prevent BellPal from instituting proceedings for the infringement of intellectual property against you or for non-payment against you in a country where such infringement or non-payment has allegedly occurred or in your country of residence.
